It depends on the ball circumstances. In the dead ball situation, the ref is not going to give the ball to the opponent, but if the game is on, the ref should call a foul and give the ball to the opponent. Saying that, in time wasting situation, certainly the ball must be dead and the ref can't call for a foul.

In Zidane-Materazzi situation, the ball played and shirt-pulling happened, the ball went to the out, that's why the head-butting happened during the "goal-kick".
